Terms and Conditions

1. Right of Rescission
You may cancel your contractual statement without stating any reasons within two weeks after receipt of the goods by returning the unused goods. It is important to note that only unused items in perfect condition are accepted as returns.

2. Rescission Consequences
In the eventuality of an effective rescission the services received on both sides are to be returned and if necessary any ensuing deriving benefits must also be returned. If you are not able to return the goods received to us in a perfect and non-used condition, then Luma Vertriebs GmbH and its sales partners may charge for the goods in full.

3. Delivery
The deliveries are made by post and worldwide. If an urgent shipment is requested, additional fees are charged.

4. Guarantee
If the items delivered manifest material or production defects, including transportation damage, then please notify Luma Vertriebs GmbH, its sales partners or your delivery service of these defects immediately. If you fail to make your complaint in time we do not assume any guarantees apart form the legal requirements.

5. Non-delivered items
If a specific item cannot be delivered, then we undertake to inform you thereof immediately and to deliver the goods to you at a later time.

6. Price Validity
The prices stated in the product catalogue or on the internet are valid plus the proportion for shipping costs and are inclusive of the legal rate of VAT.

7. Cost of Return Shipments
These costs are not assumed by Luma Vertriebs GmbH or its sales partners.

8. Payment
The goods are delivered to you in accordance with your chosen payment methods.

9. Retention of Title
The goods remain under our ownership until complete payment has been received.

10. Data Protection
All personal data is handled in strict confidence. The data required for the business transactions is saved and is only forwarded to associated companies within the context of the order processing if this is required. Only generally accessible and published data is forwarded to third parties for external marketing purposes.

11. Exclusion and Limitation of Liability
Luma Vertriebs GmbH and its sales partners do not assume any liability for losses or claims from third parties which are incurred from the installation. Luma Vertriebs GmbH and its sales partners do not assume any liability for damages or losses which are caused by the installation or as a result of defective functionality, flat batteries or repairs.

Defects in the delivered item including the manuals and other documentation are redressed by the supplier within the legally prescribed period of two years after delivery after a relevant notification by the user. On the choice of the customer this is carried out either by a free-of-charge repair or a replacement delivery. In the case of a replacement delivery the purchaser is under the obligation to return the defective item.

If the defects cannot be corrected within a reasonable timeframe or if the repairs or replacement delivery for other reasons are viewed as foundering, then the purchaser has the option to either demand a reduction in the payment or to withdraw from the contract. A failure of the repairs is only to be assumed if the supplier has been granted sufficient opportunities to repair or deliver a replacement without the desired success being achieved, or if the repair or replacement delivery has been made possible and it has been refused by the supplier or unreasonably delayed, or if justified doubts in view of the chances of success exist or if there are unreasonable demands for other reasons.


12. Examination and Notice of Non-Conformity:
The purchaser is under the obligation to examine the delivered goods for obvious defects which would easily attract the attention of an average customer. Obvious defects also include missing manuals and considerable, slightly visible damage to the goods. This also includes cases when a different item has been delivered or too small a quantity has been delivered. Such obvious defects are to be notified to the supplier in writing within four weeks of delivery.

Defects which only later become obvious must be notified to the supplier within four weeks after they were first noticed by the user.

If there is an infringement of the examination and notice of non-conformity, the goods are deemed as approved in view of the defect concerned.


Any liability in the case of misuse is excluded – the user is liable for any ensuing damage.
